1. Acceptance of Terms
By downloading, registering for, or using the SwiftCart application or website, you agree to be bound by these Terms of Service. If you do not agree, do not use SwiftCart.
These Terms apply to all users: customers, vendors, and riders. Vendors and riders are also subject to their specific terms linked below.
2. About SwiftCart
SwiftCart is a marketplace technology platform that connects customers with local vendors and delivery riders in Nigeria. SwiftCart:
- Does NOT manufacture, own, or sell products listed by vendors
- Does NOT employ riders (riders operate as independent service providers)
- Does NOT guarantee the quality, safety, or legality of any product listed on the platform
- Is NOT a bank, financial institution, or regulated payment service
3. Eligibility
To use SwiftCart you must:
- Be at least 18 years of age
- Have a valid Nigerian phone number capable of receiving SMS
- Provide accurate registration information
- Not have been previously suspended or banned from SwiftCart
4. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account password and OTP codes
- All activity that occurs under your account
- Keeping your contact information current and accurate
- Notifying us immediately at support@swiftcartapp.co if you suspect unauthorized access
You must NOT:
- Share your account credentials with another person
- Create multiple accounts to exploit promotions or avoid suspension
- Impersonate another person or entity
- Use automated bots or scripts to interact with the platform
5. Placing Orders
5.1 Order Contract
When a customer places an order and a vendor accepts it, a direct contract is formed between the customer and the vendor. SwiftCart facilitates this transaction but is not a party to it.
5.2 Order Accuracy
Customers are responsible for providing an accurate delivery address. SwiftCart and riders are not liable for failed deliveries caused by incorrect addresses.
5.3 Availability
Product availability is managed by vendors. SwiftCart does not guarantee that any listed item will be in stock at the time of order.
5.4 Pricing
Prices are set by vendors. SwiftCart displays prices as provided and is not responsible for vendor pricing errors. In the event of a pricing dispute, the amount charged at checkout is the binding price.
6. Payments
6.1 Payment Processing
Payments are processed by Paystack. By making a payment, you also agree to Paystack's terms and privacy policy.
6.2 Failed Payments
Orders are only confirmed upon successful payment verification. If your payment fails, your order is not placed.
6.3 Receipts
Digital receipts are generated for every successful transaction and are accessible in your order history.
7. Cancellations
7.1 Before Vendor Acceptance
Orders may be cancelled for a full refund before the vendor has accepted the order.
7.2 After Vendor Acceptance
Cancellations after vendor acceptance may incur a cancellation fee to compensate the vendor for preparation costs. See the Refund Policy for full details.
7.3 After Rider Pickup
Once a rider has picked up an order, the delivery fee portion is non-refundable.
7.4 Vendor-Initiated Cancellations
If a vendor cancels your order after acceptance, you are entitled to a full refund of the order amount including delivery fee. SwiftCart will process this refund within 3–5 business days.
8. Refunds
Refunds are processed to the original payment method. Processing times:
- Card payments: 3–7 business days (subject to your bank)
- Wallet credits (if applicable): Processed within 24 hours
SwiftCart reserves the right to investigate refund requests before approval. Fraudulent or abusive refund requests will result in account suspension.

9. Delivery
9.1 Delivery Responsibility
Delivery is performed by independent riders. SwiftCart provides the coordination platform but does not directly control rider behavior.
9.2 Delivery Estimates
Delivery time estimates are approximations only. SwiftCart is not liable for delays caused by traffic, weather, rider availability, or circumstances beyond our control.
9.3 Delivery Limitations
Delivery is only available within operational service zones as shown in the app. Attempting to place orders outside the active delivery zone may result in order cancellation.
9.4 Undeliverable Orders
If a rider is unable to complete delivery due to customer unavailability (e.g., no response at delivery location, wrong address), the delivery fee is non-refundable. The order will be handled per our failed delivery policy.
10. Prohibited Activities
You must NOT use SwiftCart to:
- Order, sell, or transport illegal goods or controlled substances
- Engage in fraud, deception, or misrepresentation
- Harass, threaten, or abuse riders, vendors, or SwiftCart staff
- Use the platform to conduct transactions outside SwiftCart (off-platform solicitation)
- Manipulate ratings or reviews
- Submit false reports or fraudulent complaints
- Attempt to hack, reverse-engineer, or disrupt the SwiftCart platform
- Place fake orders with no intent to complete payment or receive delivery
11. Ratings and Reviews
Customers may rate vendors and riders after order completion. Ratings must be honest and based on genuine experience. SwiftCart may remove ratings that violate our community guidelines or appear fraudulent.
12. Platform Disclaimers
SwiftCart is NOT liable for:
- Product quality or safety issues arising from vendor goods
- Rider accidents or injuries during delivery
- Losses arising from app downtime or technical failures
- Third-party payment processing failures
- Acts of God, civil unrest, or force majeure events
13. Limitation of Liability
To the maximum extent permitted by law, SwiftCart's total liability to you for any claim arising from use of our platform shall not exceed the amount paid by you for the specific transaction giving rise to the claim.
14. Suspension and Termination
SwiftCart may suspend or permanently terminate your account without notice if you:
- Violate these Terms or any applicable law
- Engage in fraud, abuse, or harassment
- Provide false or misleading information
- Repeatedly generate invalid refund claims
- Create safety risks for riders, vendors, or other users
You may close your account at any time by contacting support@swiftcartapp.co. Account closure is subject to resolution of any outstanding orders, disputes, or financial obligations.
15. Dispute Resolution
15.1 Internal Resolution
Most disputes should be resolved through our in-app support or by contacting support@swiftcartapp.co. We aim to respond within 48 hours.
15.2 Escalation
Unresolved disputes may be escalated to formal mediation. SwiftCart reserves the right to make final determination on disputes relating to order fulfilment, delivery fraud, and refunds, based on available evidence including GPS data, order logs, and rider/vendor communications.
15.3 Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any unresolved dispute shall be submitted to the jurisdiction of the courts of Lagos State, Nigeria.
16. Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be notified via the app with at least 7 days' notice. Continued use after the effective date constitutes acceptance.
